Your Constitutional Rights
in a Florida Criminal Case

The most dangerous thing you can do after an arrest is talk. Police are trained to get you to incriminate yourself. You have powerful rights — but only if you invoke them clearly and immediately.

Right to Remain Silent
You are not required to answer questions. Say clearly: "I am invoking my right to remain silent." Then stop talking. Anything you say will be used against you.
Right to an Attorney
You have the right to an attorney before and during any questioning. Say: "I want an attorney." All questioning must cease until your attorney is present.
Right Against Unlawful Search
You can clearly state you do not consent to a search. This does not stop police from searching, but it preserves your right to challenge the search in court.
Right to Know the Charges
You must be formally informed of the charges against you. An attorney can obtain this information immediately and begin building your defense.
Right to a Speedy Trial
Under Florida Rule 3.191, misdemeanor defendants must be tried within 90 days of arrest; felony defendants within 175 days. Your attorney can use this as a strategic tool.
